# 1. Who we are

This website, drinkpiklo.com, is operated by **Piklo LLC**, Ooltewah, Tennessee ("Piklo", "we",
"us", "our"). By visiting this site or placing an order you agree to these Terms of Service.

If you do not agree to these terms, please do not use this site.

## 2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order.
By ordering you confirm that the payment method you use is your own.

## 3. The product

Piklo is a sweet pickle soda — a carbonated soft drink. It is a food product, not a supplement,
and it is not intended to diagnose, treat, cure or prevent any disease.

**Ingredients and allergens.** The full ingredient list and Nutrition Facts panel are published on
this site and printed on every can. If you have a food allergy, a medical condition, or you are
pregnant or nursing, read the label and speak to a doctor before drinking Piklo. **The can itself
is the authority** — if anything on this site differs from the printed label, the label governs.

**Descriptions.** We work hard to describe the taste honestly, because it is a bold flavour and it
is not for everyone. Taste is subjective, and liking or disliking it is not a defect in the product.

## 4. Pricing and availability

All prices are in US dollars and may change without notice. Products are subject to availability
and we may limit quantities per order or per customer.

We try to keep everything accurate, but if a product is listed at an incorrect price or with an
incorrect description because of an error, **we may cancel or refuse any order placed at that
price**, even after you have received an order confirmation. If your payment has been taken, we
will refund it in full.

## 5. Orders

Your order is an offer to buy. A confirmation email acknowledges that we received it — it is not
acceptance. The contract is formed when we ship.

**We may refuse or cancel any order,** in whole or in part, at our discretion. Reasons include
suspected fraud, a reseller or bulk order we have not agreed to, an address we cannot ship to, a
pricing error, or a product being unavailable. Where we cancel, we refund in full.

## 6. Payment

Payment is taken at checkout through Shopify's payment processing. We do not store your full card
details. You are responsible for any taxes or duties that apply.

## 7. Shipping and risk

Shipping is governed by our **Shipping Policy**, which forms part of these terms.

Title and risk of loss pass to you on delivery to the address you gave at checkout.

## 8. Returns and refunds

Refunds are governed by our **Refund and Return Policy**, which forms part of these terms. In
summary: because Piklo is a sealed food product we do not accept returns, and we cover
non-delivery, damage in transit, and incorrect items.

## 9. Photographs of your content

If you tag us, send us a photo or video, or post about Piklo publicly and tag our accounts, **you
give Piklo LLC a non-exclusive, royalty-free, worldwide licence to re-share that content** on our
website, social accounts and marketing, with credit to your handle where practical.

You confirm that the content is yours to share, that anyone identifiable in it has agreed, and that
it does not infringe anyone else's rights. You can ask us to take your content down at any time by
emailing **piklollc@gmail.com**, and we will remove it from anything we control.

## 10. Reviews and submissions

Reviews and comments you submit must be your own honest experience. We may publish, decline to
publish, edit for length, or remove any submission. We do not publish content that is unlawful,
abusive, impersonates someone, or is posted on behalf of a competitor.

Do not submit anything containing personal health information you would not want published.

## 11. Our intellectual property

The Piklo name, logo, can artwork, photography, website design, text and code are owned by Piklo LLC
or its licensors and are protected by copyright and trademark law.

You may not copy, reproduce, republish or use any of it commercially, or use our branding to imply
an endorsement or partnership, without our written permission.

## 12. Acceptable use

You agree not to use this site to break any law, to interfere with or attempt to gain unauthorised
access to it, to scrape or harvest data from it, to resell our products without our written
agreement, or to transmit malicious code.

## 13. Disclaimer of warranties

This site and everything on it is provided **"as is" and "as available"**, without warranties of any
kind, express or implied, to the fullest extent permitted by law. We do not warrant that the site
will be uninterrupted, secure or error-free.

Nothing in this section limits any warranty implied by law that cannot lawfully be excluded, and
nothing here excludes liability for death or personal injury caused by our negligence, or for fraud.

## 14. Limitation of liability

To the fullest extent permitted by law, Piklo LLC and its owners, employees and suppliers are not
liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of
profits, revenue, data or goodwill, arising out of your use of this site or any product bought
through it.

**Our total liability for any claim relating to an order will not exceed the amount you paid for
that order.**

Some jurisdictions do not allow these limitations, so parts of this section may not apply to you.

## 15. Indemnity

You agree to indemnify Piklo LLC against any claim, loss or expense arising from your breach of
these terms or your misuse of this site.

## 16. Governing law and disputes

These terms are governed by the laws of the **State of Tennessee**, without regard to its conflict
of law rules. You agree that any dispute will be brought in the state or federal courts located in
**Hamilton County, Tennessee**, and you consent to their jurisdiction.

## 17. Severability

If any part of these terms is found unenforceable, the rest remains in force.

## 18. Changes

We may update these terms at any time. The version on this page at the moment you order is the one
that applies to that order.
